The High Court of Uganda at Rukungiri has issued an interim order in the ongoing legal dispute between Miss Tourism Kigezi Initiative Ltd and Miss Tourism Uganda - Pearl of Africa and Ms. Zakia Lucky. The order, delivered today by Her Worship Oliver Nantamu, Acting Assistant Registrar, restrains the defendants from infringing on the plaintiff's trademark and conducting a competing beauty pageant.
Details of the Order
The court order specifically states that:
1. The respondents, Miss Tourism Uganda - Pearl of Africa and Ms. Zakia Lucky, are jointly and severally restrained from using the Miss Tourism Kigezi trademark and from presenting their activities as part of the Miss Tourism Kigezi pageant.
2. The respondents and their agents are prohibited from organizing or promoting the Miss Tourism Kigezi beauty pageant, including stopping all online voting and advertising for their event planned for June 15, 2024.
3. The costs of this application will be determined in the main case.
Context of the Dispute
Miss Tourism Kigezi Initiative Ltd, represented by Bwagi & Co. Advocates, filed the lawsuit to protect its independently managed pageant, which it has run since 2016. The plaintiff claims that the defendants' actions have caused confusion and disrupted their preparations for the Miss Tourism Kigezi 9th Edition.
The interim order will remain in effect until the court resolves Civil Misc. Application No. 022 of 2024, which is directly connected to the main lawsuit, Civil Suit No. 014 of 2024.
